As of 1 December 2010, all properties with a pool are required to have a valid pool safety certificate. A pool safety certificate ensures your pool complies with all Queensland pool safety laws and standards. All certification inspections must be completed by a licensed pool inspector to ensure your pool is as safe as possible. If your pool passes, you will receive your pool safety inspection certificate on the same day.

For non-shared pools, pool safety certificates are valid for two years. For shared pools, like those found in hotels and apartments, certificates are valid for one year.
No, you do not. Instead, you can submit Form 36 – Notice of No Pool Safety Certificate to your buyer. However, there can be a few issues with taking this route. Many buyers are not keen on purchasing a property with a pool that is out of date. Instead, they want a safe pool they can use immediately and don’t want to pay for repairs when buying a new home. Others may demand that any issues are fixed before purchasing the home so that the pool is compliant. If you decide to submit Form 36 to your potential buyer, they will most likely request a pre-purchase pool inspection to see the cost of bringing the pool up to code. We recommend completing an inspection to make the selling process easier for you—and avoid the headache of attempting to sell without a certified safe pool. If you do go ahead and submit a Form 36, the buyer then has 90 days to get the pool up to code after settlement. Also, Form 36 in no way clears the seller from having a non-compliant pool. It is the law for a pool owner to ensure the safety of the pool fence at all times. Non-compliance can result in a hefty fine, sometimes up to $22,000 not to mention the potential health risks.
The pool safety standards are clear about which pools require a pool safety certificate. They cover swimming pools, spas and portable pools holding more than 300 millimetres of water or more. If you would like more clarity on this regulation, our pool safety experts are ready to help you.
To get a pool certificate, you will need a pool safety inspection done by a QBCC licenced and insured pool inspector. Poolinspec pool safety inspection charges are from $80 excluding GST. You can sell a property without a pool safety certificate. However, if you choose to do this, you must give the buyer a notice of no pool safety certificate (Form 36) before entering a sale contract. You’ll need to send the completed copy of the Form 36 to the QBCC (firstname.lastname@example.org) before settlement. But, more importantly, if you are submitting a form 36-notice of no certificate, your pool must still be compliant. Having a Form 36 does not prevent local government from enforcing action against you if your pool is not compliant. Also, the buyer has 90 days from the date of settlement to get a pool safety certificate. It is the seller’s responsibility to complete the Form 36 – Notice of no pool safety certificate (L) and give a copy to the buyer and also the QBCC.
If you sell, lease or buy a property in Queensland with a pool; you need a new pool safety certificate issued by a licenced pool safety inspector registered with the QBCC.
You can only get a pool certificate issued by instructing a qualified and licenced pool safety inspector to inspect your pool. To save you time and money, before giving us a call to come and do an inspection, first check out our pool safety checklist to see if your pool complies.
If our inspector finds your pool to be non-compliant, you can avoid receiving a certificate of non-conformity by committing to do the necessary repairs within 48 hrs. We’ll go through an easy to understand report with you explaining all the areas that need attention to comply. Failing to do the repairs within this time, we will issue a non-conformity certificate, and you will get 90 days to make the repairs before the next inspection. The same inspector has to do the re-inspection of your pool once the repairs are done.
A pool certificate for a non-shared pool is valid for two years and one year for a shared pool. However, you are only required to get a new pool safety certificate when you sell or lease the property with the pool. If the pool certificate is current at the time of settlement, you don’t have to get a new certificate. It remains the property owner’s responsibility to maintain the pool and barrier to comply with the pool fence standards at all times. Failing to maintain your barrier could result in severe penalties from the local government should they do a random inspection on your property.
If the seller gives you a notice of no pool safety certificate (Form 36) before you enter into an offer to purchase, you can get a pre-purchase inspection done. This inspection will establish if any works need to be carried out on the pool barrier to ensure it’s compliance. The benefits of getting a pre-inspection are that you would be able to know the costs of any necessary repairs before entering into an offer.
You can only get an exemption from complying with the pool safety standards if either of the following applies:
For newly built pools, a Final Inspection Certificate (Form 17) or Certificate of Classification issued by the building certifier replaces a pool certificate. This certificate for a non-shared pool is valid for 2 years and must confirm that the pool meets the safety laws and must be lodged by the building inspector with the QBCC at email@example.com.
Before entering into a lease, you must receive a valid pool safety certificate from the owner of the property. If a valid certificate is not available, the property owner must get a pool safety inspection done on the pool before leasing the property. Failing which, the owner of the property risks getting a hefty fine at random inspections by the QBCC. Not only that, but the lives of young children are at risk with non-compliant pools.

However, if there is no valid certificate linked to your address, then you need to get a pool safety inspection done.
